On February 19, 2016 the Copyright Board of Canada released its long-awaited decision on tariffs proposed by Access Copyright (AC) for copying in K-12 schools and school boards outside of Quebec.  The Board certified tariff rates of $2.46 per FTE for 2010-2012 and $2.41 per FTE for 2013-2015, pertaining only to photocopying of literary works.  In its news release, the Board noted the main reason for the decreased rates is due to the Supreme Court decision in Alberta v Access Copyright, 2012 SCC 37, which led the Board to find that "a significant portion of copying by elementary and secondary schools was fair under the fair-dealing provisions of the Copyright Act. These copies therefore do not generate remuneration."
