On January 27, 2017 the Federal Court of Appeal delivered its judgment in the judicial review sought by Access Copyright of the Copyright Board's 2010-2105 K-12 tariff decisions. The Court found no reviewable errors in the Copyright Board's analyses pertaining to fair dealing and what does or does not constitute a "substantial part." The Court ruled the only reviewable error requiring reconsideration by the Board is a technical matter regarding estimation of the size of Access Copyright's repertoire.
