Both York and Access Copyright (AC) have filed applications seeking leave to appeal to the Supreme Court of Canada regarding the April 22, 2020 Federal Court of Appeal (FCA) decision in York University v. Access Copyright. York is appealing the FCA finding that York's fair dealing guidelines are not fair. AC is appealing the FCA finding that Copyright Board-certified tariffs are not enforceable against non-licensees.
